PROVISION OF OUR SERVICES AS DATA PROCESSOR

NUNSYS, S.A, WILL ALWAYS ACT AS DATA PROCESSOR for the provision of services contracted by our clients, in all our Transport solutions.

 

OBLIGATIONS OF NUNSYS, S.A, AS DATA PROCESSOR

Confidentiality and Security: The data controller undertakes to ensure the confidentiality of the personal data processed and to adopt appropriate technical and organisational security measures to protect the data against unauthorised access, loss, alteration or destruction.

Compliance with Instructions: The data processor undertakes to process personal data exclusively under the documented instructions of the controller, as described in these terms of use.

Use of Subcontractors: If it is necessary to subcontract any processing services, the data processor will inform the data controller in advance and ensure that the subcontractor complies with the same obligations established in this document.”

BATONROUTE APP CONDITIONS AND USE

Account Registration and Security

User Account: In those cases in which the provision of service contracted by our clients is conditional on the prior completion of the corresponding user registration, this will be carried out in the manner expressly indicated in the service section itself.

For this purpose, the CLIENT will inform the Users of the existence of the BATONROUTE contract, which will offer the option of registering through the system, by means of an email communication that the CLIENT itself will send through the BATONROUTE system.

The user is responsible for the security of his/her account, including the confidentiality of his/her password.

The user guarantees the authenticity and veracity of the data provided through the forms for the subscription of the services. It will be the user’s responsibility to keep all the information provided permanently updated so that it reflects, at all times, his/her real situation. In any case, the user will be the sole responsible for any false or inaccurate statements made and for any damages caused to the provider or third parties.

Notification of Unauthorized Access: Please immediately report any unauthorized use of your account or any other breach of security.

END USER RIGHTS

Our CLIENTS, as Data Controller, are obliged to ensure that users can exercise their rights of access, rectification, deletion, limitation of processing, data portability and opposition. The processor will collaborate with the controller to facilitate the exercise of these rights when necessary and will act according to the controller’s instructions upon receiving such requests from users.

INTELLECTUAL AND INDUSTRIAL PROPERTY

The contents of all kinds included in the batonroute app, including, but not limited to, images, illustrations, photographs, texts, brands, logos or designs, are the property of NUNSYS S.A. and/or other legitimate collaborators who have granted it the corresponding rights of use. The industrial and intellectual property of all the aforementioned contents are duly protected by Spanish legislation. Any total or partial use of the contents of the portal consisting of reproduction, distribution, public communication in any form and by any means is strictly prohibited, except with the express written authorization of NUNSYS S.A.

EXCLUSION OF WARRANTIES AND LIABILITY

NUNSYS S.A. is not responsible for the legality of other third-party websites from which the portal may be accessed, nor is it liable for the legality of other third-party websites that may be linked or connected from this portal.

Likewise, it is not responsible for the use that third parties make of the information published on the portal, nor for any damages of any kind that may be caused by the use of said information.

The entity reserves the right to remove any comments and contributions that violate respect for human dignity, that are discriminatory, xenophobic, racist, pornographic, that threaten youth or childhood, public order or security, or that, in its opinion, are not suitable for publication. In any case, the entity will not be responsible for the opinions expressed by users through forums, chats, or other tools.

The user agrees to make appropriate use of the content and services that the entity offers through the BATONTOUTE app contracted by their organization.

COMPENSATION

You agree to indemnify and hold NUNSYS, S.A. and its affiliates, directors, employees and agents harmless from any claims, damages or expenses arising from your use of the App, your violation of these Terms and Conditions or any applicable law.

DATA PROTECTION

NUNSYS, S.A. complies with the provisions of Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 and other current regulations, regarding the processing of the user’s personal data. MINORS

The responsibility for determining the specific content that minors access lies with the parents or legal guardians.

LIMITATION OF LIABILITY

NUNSYS, S.A. is not responsible for indirect, incidental or consequential damages that may result from the use or inability to use the App. Your use of the App is at your own risk, and you acknowledge that it is offered “as is”.

MODIFICATION OF THESE CONDITIONS AND DURATION:

NUNSYS S.A. may modify the conditions set forth in these Terms and Conditions at any time.

The validity of the aforementioned conditions will depend on their exposure and will be valid until they are modified by others.

TERMINATION

We may suspend or cancel your account and your access to the App at any time, without prior notice, if we believe that you have violated these Terms and Conditions or any applicable law. After termination, you must stop using the App and delete all copies of it.

APPLICABLE LEGISLATION AND JURISDICTION

For the resolution of disputes or issues related to this website that may arise between the entity and the user, Spanish legislation will apply, to which the parties expressly submit, the Courts and Tribunals of Valencia being competent for the resolution of all conflicts derived or related to its use.
